The City of Kemmerer has passed, approved and adopted on Third Reading Ordinance No. 2019-861: Amending Section 23-5 Definition of Terms; Section 23-20  Agriculture Combining District– A; Section 23-126 Fencing. Purpose; Section 23-127 Effect Of Section On Covenants, Agreements, Etc.; Section  23-128 Permits; Section 23-129 Fencing Residential; Section 23-132. Vacant Lots; Section 23-133 Fencing. Barbed Wire; Section 23-137 Exceptions.; and Article  XIV. RE – Very Low Density Residential; of the Kemmerer City Codes.

This ordinance becomes law upon the publication of this notice.

CITY COUNCIL PROCEEDINGS

The Kemmerer City Council met in regular session this 12th day of August, 2019, at 7 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming.  The Pledge of Allegiance was recited.

Present on roll call were Mayor Anthony Tomassi, Councilman Robert Bowen, Councilman David Crosland, Councilman David McGinnis, Councilman Vance Chamberlain, Councilman Eric Rudy and Councilman Mark Quinn.

Motion was made by Councilman Bowen to approve the agenda for August 12, 2019 as amended; seconded by Councilman Quinn and unanimously approved by Council.

VISITORS’ COMMENTS AND PETITIONS:

Andrew Kaiser commented on the proposed ordinance on zoning changes.

Thomas Lively, representing the Oyster Ridge Music Festival group, thanked the council and city staff for their help with the festival.

OLD BUSINESS:

NEW BUSINESS:

(a) Motion was made by Councilman Bowen to approve the City of Kemmerer Sole-Sourcing Policy dated August 12, 2019 as amended and note that the Bobcat skid steer was purchased under this policy; seconded by Councilman Quinn and unanimously approved by Council.

(b) Motion was made by Councilman Crosland to table this item; seconded by Councilman Bowen and unanimously approved by Council.

(c) Motion was made by Councilman Bowen to authorize the Mayor to sign the new MOU for the EDA grant and appoint Mark Quinn to that Board; seconded by Councilman McGinnis and unanimously approved by Council.

(d) Motion was made by Councilman Bowen to authorize the Mayor or Councilman Quinn to move forward with application for the EDA grant with the understanding that Resolution 2019-767 and Resolution 2019-768 will be considered as one grant application and award; seconded by Councilman McGinnis and unanimously approved by Council.

COMMENTS:

Comments were made by Councilman Bowen, Councilman McGinnis, Councilman Chamberlain,  and Mayor Tomassi.

EXECUTIVE SESSION:

Motion was made by Councilman McGinnis to recess into Executive Session to discuss pending litigation; seconded by Councilman Quinn  and unanimously approved by Council,  8:57 p.m.

Copies of the CONTRACT DOCUMENTS may be obtained at the office of Crank Companies, Incorporated at the address given above upon payment of $40.00 for each set, which payment will not be refunded.

All bids must be accompanied by either a certified check, cashier’s check drawn on an acceptable bank, or an acceptable BID BOND, executed by an approved Surety Company, in an amount not less than five percent (5%) of the total sum of the bid.  The check or bond shall be made payable to the OWNER and will be retained by said OWNER as liquidated damages if the successful bidder refuses or fails to enter into a contract and bond in accord with his bid when notified of the award.

A MANDATORY Pre-Bid conference will be held at 1:00 P.M. on September 12, 2019 at the South Lincoln Special Cemetery District’s Office, 530 Fossil Butte Dr, Kemmerer, Wyoming.  Representatives of OWNER and ENGINEER will be present to discuss the Project.  Notice is hereby given that attendance of the Pre-Bid Conference for the project is MANDATORY for all prospective bidders.  The District will reject bids submitted from any BIDDER who failed to attend the Pre-Bid conference.

All questions about the meaning or intent of the Bidding Documents are to be submitted to ENGINEER in writing.  Interpretations or clarifications considered necessary by ENGINEER in response to such questions will be issued by Addenda mailed or delivered to all parties recorded by ENGINEER as having received the Bidding Documents. Questions received AFTER 4:00 P.M. local time September 12, 2019 may not be answered.  Only questions answered by Addenda will be binding.  Oral and other interpretations or clarifications will be without legal effect.

COMPLAINT FOR FORCIBLE ENTRY AND DETAINER

UNDER W.S. §1-21-1002(A)(1)

COME NOW, Roger Schanzenbach and Big Red Real Estate, LLC, Plaintiffs herein, through counsel, Greenwood Law, LLC, by Elizabeth Greenwood and Inga L. Parsons, of counsel, and pursuant to W.S. §1-21-1002(a)(i) hereby file their Complaint for Forcible Entry and Detainer against Defendants, as follows: 1. Plaintiff, Roger Schanzenbach, is the owner of and is entitled to the possession of certain real property physically located at 411 W. 4th Street, LaBarge, Lincoln County, Wyoming (hereinafter “the property”. Plaintiff Schanzenbach is solely on the deed for the property. 2. Plaintiff, Big Red Real Estate, LLC, is the property manager for Plaintiff Schanzenbach with regard to the property and is listed as the Lessor in the lease with Defendant Jarin Smith, which has been terminated due to non-payment of rent. (See lease documents attached hereto as Exhibit A). 3. Defendant Brianna Faurote has been occupying the property with Jarin Smith since approximately June of 2018. 4. Defendants have been and continue to occupy the property against the wishes of the Plaintiffs. 5. Defendants have not paid rent since February 19, 2019 and are behind on rent in the amount of $2786.35 plus late fees in the amount of $1440.50 for a total due, to-date, of $4226.75. (See Tenant Statement attached hereto as Exhibit B). 6. Late fees continue to incur at the rate of $15.00 per day and will increase to $38.00 per day. 7. Defendants were served a Notice to Quit on July 11th, 2019 at 2:50 p.m. (See Notice to Quit attached hereto as Exhibit C). 8. Defendants have not vacated the property to-date and are in violation of W.S. 1-21-1002(a)(i); as such, Plaintiffs Complaint for Forcible Entry and Detainer should be granted along with all applicable remedies under the law, and Defendants should be ordered to vacate the property. 9. For other good and just cause. WHEREFORE, Plaintiffs pray that this Court: a. Enter a Judgment against the Defendants in the amount of $4226.75 plus attorneys’ fees and costs and any additional late fees and charges incurred. b. Grant Plaintiffs restitution of the premises and that Defendants and any persons occupying the premises as assignees, guests, invitees, or otherwise, be ejected therefrom and that a Writ of Restitution be issued in the event the Defendants fail to vacate the property; and c. Grant such other and further relief deemed just and proper.
