WHEREAS, default in the payment of principal and interest has occurred under the terms of a promissory note (“Note”) and real estate mortgage (“Mortgage”).  The Mortgage dated November 24, 2014, was executed and delivered by Michael Glen Tully, a married man and Arieon L. MEETING MINUTES

The Kemmerer City Council met in regular session this 9th day of September, 2019, at 7 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming.  The Pledge of Allegiance was recited.

 Present on roll call were Mayor Anthony Tomassi, Councilman Robert Bowen, Councilman David McGinnis, and Councilman Eric Rudy. Absent were Councilman Vance Chamberlain, Councilman Brian Crosland and Councilman Mark Quinn.

 Motion was made by Councilman Rudy to unexcuse the absence of Councilman Chamberlain, Councilman Quinn and Councilman Crosland; seconded by Councilman McGinnis and approved by Council present with Councilman Bowen voting “Nay”.

 Motion was made by Councilman Bowen to approve the agenda for September 9, 2019 as amended; seconded by Councilman McGinnis and unanimously approved by Council present.

VISITORS’ COMMENTS AND PETITIONS:

Shawn Crank and Michael Clark, representing the Interact Club, provided an update to Council regarding the project at pool.

OLD BUSINESS:

(a) Motion was made by Councilman Bowen to approve the SLTEC Scholarship Program Policy as presented; seconded by Councilman Rudy and unanimously approved by Council present.

NEW BUSINESS:

(a) Motion was made by Councilman McGinnis to authorize the Mayor to sign a contract with Shums Coda Associates for as needed plan check and building inspection services at the rates listed in their proposal, for a two year term from September 2019 to June 2021, with an optional one year extension to June 2022, subject to negotiations of a final agreement; seconded by Councilman Bowen and unanimously approved by Council present.

COMMENTS:

Comments were made by City Administrator Muir and Mayor Tomassi.

 Motion was made by Councilman McGinnis to recess the regular meeting to go into Executive Session for real estate; seconded by Councilman Rudy and unanimously approved by Council present,  7:19 p.m.

 Motion was made by Councilman Bowen to reconvene the regular meeting; seconded by Councilman Rudy and unanimously approved by Council present, 7:55  p.m.

 There being no further business before Council, motion was made by Councilman Bowen the meeting be adjourned; seconded by Councilman Rudy and unanimously approved by Council,  7:55 p.m.

Motion was made by Councilman McGinnis to authorize the Mayor to sign the agreement for the EDA grant in the amount of $138,950 for an economic development strategy and hiring an impact manager for the City of Kemmerer; seconded by  Councilman Quinn and unanimously approved by Council present.

Bennett Construction Co. Inc. of Marbleton, Wyoming and the Contractor is entitled to settlement thereof.

Default having occurred and all prerequisites to foreclosure having been met, notice is hereby given that the mortgage given by Edmond Wilson Davison, a married man, mortgagor, in favor of First Bank, Division of Glacier Bank, mortgagee, dated August 27, 2018, recorded August 28, 2018, in Book 931PR, on Page 654, in the Office of the Clerk of Lincoln County, Wyoming, given to secure payment of a note in the original amount of Two Hundred Fifty Two Thousand Five Hundred Twenty Five Dollars and 00/100 ($252,525.00).  Said note and mortgage were assigned to the Wyoming Community Development Authority by Assignment dated March 8, 2019, and recorded March 20, 2019, in Book 944PR, on Page 390, in the Office of the Clerk of Lincoln County, Wyoming.  The past amount due as of September 16, 2019, is Ten Thousand Six Hundred One Dollars and 82/100 ($10,601.82), plus accruing late fees, interest, fees and costs, and the amount due as of September 16, 2019, is Two Hundred Fifty Eight Thousand Thirty Four Dollars and 03/100 ($258,034.03),  plus accruing interest, fees and costs. Said mortgage contains a power of sale which by reason of default the owner of the Note and Mortgage declares to have become operative and no suit or proceeding has been instituted at law to recover the debt secured by the mortgage or any part thereof, nor has any such suit or proceeding been instituted and the same discontinued.  Written notice of intent to foreclose the Mortgage by advertisement and sale has been served upon the record owner and the party in possession of the mortgaged premises at least ten days prior to the commencement of this publication.  The property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale and any prospective purchaser should research the status of title before submitting the bid.

NOTICE TO APPROPRIATORS OF WATER

Public notice is hereby given that the following listed water users have completed the requirements of appropriation and beneficial use of ground water for the following wells as approved by the State Engineer.  Pursuant to Wyoming Statutes §§ 41-4-511 and 41-4-513, the following proofs of appropriation will be held open for public inspection from October 7 through October 11, 2019, during the hours of 9:00 a.m. until 5:00 p.m., at the following location(s):  State Water Office, 115 Park Street, Cokeville, Wyoming; and State Engineers Office, Herschler Building 2W, 122 West 25th Street, Cheyenne, Wyoming.  Any person claiming a water right interest in the same sources of supply to which the below-advertised proofs refer may inform the Water Division Superintendent of his/her desire to contest the rights of the person or persons seeking adjudication.  The statement of contest shall be presented within fifteen days after the closing of the public inspection and shall state with reasonable certainty the grounds of the contest.  The statement must be verified by the sworn affidavit of the contestant, his/her agent or attorney.  If no contest is initiated as allowed by Wyoming Statute § 41-4-312, the advertised proofs will be submitted to the State Board of Control for consideration during its meeting beginning on November 4, 2019, with the Division Superintendent's recommendation that certificates of appropriation or construction be issued.
