The City of Kemmerer is requesting proposals for as needed Plan Check and Building Inspection Services.  Proposal packets can be picked up at Kemmerer City Hall, 220 Wyoming Highway 233, Kemmerer, WY 83101. Responses must be received by Friday, August 16, 2019, at 11:30 p.m.

Public Notice

Westmoreland Kemmerer, LLC of 6520 Elkol Co. Rd. 304, Kemmerer, WY  83101, has applied for a coal mining permit transfer from the Land Quality Division of the Department of Environmental Quality of the State of Wyoming.  Mining permit No. 379-T9 will be transferred to    Kemmerer Operations, LLC of 6520 Elkol County Road 304, Kemmerer, Wyoming 83101.  The mining permit is located in all or portions of: Sections 7, 8, 16, 17, 18, 19, 20, 21, 28, 29, 30, 31, and 32 of Township 21 North, Range 116 West, Section 24, 25, and 36 of Township 21 North, Range 117 West, Sections 26, 27, 28, 34, and 35 of Township 20 North, Range 117 West, Sections 3 and 10 of Township 19 North, Range 117 West, and Sections 2, 3, 4, 9 10, 11, 12, 14, 15, 16, 21, 22, and 23 of Township 20 North, Range 117 West, 6th P.M., Lincoln County, Wyoming.  The original permit to mine was granted as ongoing since 1975 and is estimated to continue until 2031.  The land after mining will be returned to rangeland for livestock grazing and wildlife habitat.  Information regarding the proposed permit transfer may be reviewed in the office of the Land Quality Division of the Department of Environmental Quality in Cheyenne and Lander, Wyoming, the office of Westmoreland Kemmerer, LLC’s Kemmerer Mine, or the Lincoln County Clerk’s Office in Kemmerer, Wyoming.  Written comments to the proposed mining permit transfer must be received by the Administrator, Land Quality Division of the Department of Environmental Quality, Herschler Building, 122 West 25th Street, Cheyenne, WY  82002, before the close of business September 16, 2019.  The nature of any objection must relate to the ability of the new permit holder (transferee) to meet the obligations of the permit.  The Director may hold an informal conference if requested, hear the complaint and take action on the application in accordance with the Department’s Rules of Practice and Procedure.  The complainants shall have a right of appeal to the Environmental Quality Council where the complaint will be heard a second time.  A conference shall be held if the Director determines that the nature of the complaint or the position of the complainants indicates that an attempt to informally resolve the disputes is preferable to a contested case proceeding.  An informal conference or a public hearing shall be held within twenty (20) days after the final date for filing objections unless a different period is stipulated to by the parties.  The Council or Director shall publish notice of the time, date and location of the hearing or conference in a newspaper of general circulation in the locality of the proposed operation once a week for two (2) consecutive weeks immediately prior to the hearing or conference.  The hearing would be conducted as a contested case in accordance with the Wyoming Administrative Procedure Act (W.S. 16-3-101 through 16-3-115), and the right of judicial review shall be afforded as provided in that act. CITY COUNCIL PROCEEDINGS

The Kemmerer City Council met in regular session this 8th day of July, 2019, at 7 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming.  The Pledge of Allegiance was recited.

As Mayor Tomassi was absent, President of the City Council David McGinnis chaired the meeting.

Present on roll call were Councilman Robert Bowen, Councilman David McGinnis, Councilman Vance Chamberlain, Councilman Eric Rudy and Councilman Mark Quinn. Absent were Mayor Anthony Tomassi and Councilman David Crosland.

Motion was made by Councilman Bowen to unexcuse the absence of Mayor Tomassi and Councilman  Crosland; seconded by Councilman Rudy and unanimously approved by Council present.

Motion was made by Councilman Bowen to approve the agenda for July 8, 2019 as presented; seconded by Councilman Quinn and unanimously approved by Council present.

VISITORS’ COMMENTS AND PETITIONS:

Richard Hartman addressed the council regarding potholes.

PUBLIC HEARINGS:

A public hearing was held on Budget Amendments 2019-04 and 2019-05.  There being no public comments, the public hearing was closed.

PRESENTATIONS:

Administrative Assistant, Trista Gordon, was recognized for 10 years of service with the City.

(1) Motion was made by Councilman Bowen to designate Administrative Services Director Glenda Young as the City’s public records person; seconded by Councilman Rudy and unanimously approved by Council present.

(2) Motion was made by Councilman Bowen to pass, approve and adopt Resolution No. 2019-766 – Application for TAP Grant; seconded by Councilman Rudy. President of the Council then called for the question.  Those voting” Yea” – Councilman McGinnis, Councilman Bowen, Councilman Rudy and Councilman Quinn.  Those voting “Nay” -  Councilman Chamberlain. Motion carried.

COMMENTS:

Councilman Quinn, Councilman Chamberlain, Councilman Bowen, and Councilman McGinnis made comments.

PUBLIC NOTICE

The Wyoming Public Service Commission (Commission) has authorized Questar Gas Company d/b/a Dominion Energy Wyoming (Dominion or the Company) to pass-on to its customers a wholesale gas cost increase of $0.25658 per dekatherm (Dth) and additional credits associated with the Tax Cuts and Jobs Act of 2017, effective June 1, 2019. This approval is subject to notice, protest, investigation, opportunity for hearing, change, refund, and such other orders as the Commission may deem appropriate.

A typical Dominion residential customer using an average of 2.8 Dth per month during the rate-effective period of June 1, 2019, through October 31, 2019, will see a monthly increase of approximately $0.44, or 1.49%. Actual bills will vary with usage.

Pursuant to Commission Rule Chapter 3, Section 26, a utility may apply to pass on to its customers known or prospective wholesale commodity cost increases or decreases on a dollar-for-dollar basis and subject to public notice, opportunity for hearing, and refund.

The Application is on file at the Commission’s offices in Cheyenne, Wyoming, and is available for inspection by any interested person during regular business hours or online at: http://psc.wyo.gov/.

Anyone desiring to file a request for a public hearing, intervention petition, statement, protest, or public comment in this matter must file in writing with the Commission on or before August 12, 2019. FORECLOSURE SALE NOTICE

WHEREAS, default in the payment of principal and interest has occurred under the terms of a promissory note (“Note”) and real estate mortgage (“Mortgage”).  The Mortgage dated March 22, 2004, was executed and delivered by Albert J.
