WHEREAS, default in the payment of principal and interest has occurred under the terms of a Promissory Note (the “Note”) dated March 1, 2005, executed and delivered by Joyce L. Latta aka Joyce L. Wolf and Dallas G. Notice of Initiation of the Section 106 Process – Public Participation in accordance with the FCC’s Nationwide Programmatic Agreement. Union Pacific proposes to construct a communications facility within the right-of-way at WOPL.WY.02 site (Mile Post 28.7), located approximately .87 mi SW of Wagon Wheel Rd & US 30 (Latitude: 41.75855, and Longitude: -110.4021) Opal, Lincoln County, Wyoming. The site will include a self-support telecommunications tower with an approximate overall height of 110 ft. with associated equipment. Notice is hereby given that the State Transportation Commission of Wyoming has accepted as completed according to plans, specifications and rules governing the same work performed under that certain contract between the State of Wyoming, acting through said Commission, and Lewis & Lewis, The Contractor, on Highway Project Number P112023 in Lincoln County, consisting of milling, overlay and miscellaneous work, and the Contractor is entitled to final settlement therefore; that the Director of the Department of Transportation will cause said Contractor to be paid the full amount due him under said contract on August 26, 2020.

CITY COUNCIL PROCEEDINGS
The Kemmerer City Council met in regular session this 22nd day of June, 2020, at 7:01 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming. The Pledge of Allegiance was recited. Present on roll call were Mayor Anthony Tomassi, Councilman Robert Bowen, Councilman Bill Price, Councilman Mark Quinn, Councilman John Sawaya, and Councilman Bill Thek.
Councilman Eric Rudy was absent.
Motion was made by Councilman Sawaya to unexcused the absence of Councilman Rudy; seconded by Councilman Quinn an unanimously approved by Council present.
Motion was made by Councilman Bowen to approve the agenda of June 22, 2020, as amended to include item (i) on the consent agenda, Approve the Statement of Work from Marshall Industries for the amount of $34,995.66; seconded by Councilman Thek and unanimously approved by Council present.
VISITORS COMMENTS:
Marty Carollo represent All West make comments regarding New Business item (h). Mary Ann Putnam thanked the council for the recent paving of Lincoln Heights Drive.
PUBLIC HEARING:
Mayor Tomassi opened the public hearing on Liquor License Renewals; 7:12 p.m. Seeing no public comment, the mayor closed the public hearing; 7:12 p.m.
Mayor Tomassi opened the public hearing on Budget Resolutions 2020-01 through 202008. Glenda Young commented on each Resolution. No public comment was made. The mayor then closed the public hearing; 7:24 p.m.

Motion was made by Councilman Quinn to approve the items on the consent agenda as amended; seconded by Councilman Bowen and unanimously approved by Council present. Those items were:

OLD BUSINESS:

NEW BUSINESS:
(a) Motion was made by Councilman Sawaya that the City contract with H Design Study to provide the Survey of the Concept Study and Cost Analysis and Design RFP development for the Rec Center HVAC and Domestic Water System; seconded by Councilman Price and unanimously approved by Council present.
(b) Motion was made by Councilman Bowen to authorize the Mayor to sign the Cooperative Agreement with WYDOT for salt/sand mixture; seconded by Councilman Thek and unanimously approved by Council present.
(c) Motion was made by Councilman Bowen to approve the Mark Wardell Application to Vacate the Common Lot Line between Lots 7 and 8 of Block 37 of the First Addition to the City of Kemmerer; seconded by Councilman Sawaya and unanimously approved by Council present.
Councilman Bowen recused himself from the meeting; 8:37 p.m.
(d) Motion was made by Councilman Thek to approve the Robert Bowen and Jen Edinger Application to Vacate the Common Lot Line between Lots 5 and 6 of Block 6 of the Willow Addition; seconded by Councilman Price and unanimously approved by Council present.
Councilman Bowen rejoined the meeting; 8:39 p.m.
(e) Motion was made Councilman Quinn to Pass, Approve and Adopt Resolution No. 2020-780, A Resolution Amending Resolution No. 2013-688 That Provides for the Establishment, Functions, and Duties of a Recreation Advisory Board for the City of Kemmerer; seconded by Councilman Sawaya and unanimously approved by Council present.
(f) Motion was made Councilman Bowen to Pass, Approve and Adopt Resolution No. 2020-781, A Resolution Adopting a Recreation Department Employee Handbook; seconded by Councilman Sawaya. The Mayor then called for the questions. Those voting “Yea” were Councilman Bowen, Councilman Price, Councilman Quinn, Councilman Sawaya, and Councilman Thek. Mayor Tomassi voted “Nay.” Motion carried.
(g) Motion was made by Councilman Sawaya to authorize staff to write off bad debts as presented; seconded by Councilman Bowen and unanimously approved by Council present.
(h) Motion was made by Councilman Bowen to approve the engineers potion of the blanket excavation fee in the amount of $23,048 and the bond amount of $50,000 for Phase 1 of the All West project; seconded by Councilman Quinn and unanimously approved by Council present.
COMMENTS:
Brian Muir made comments. Rachelle Points, Rec and Events Director, made comments. Councilman Sawaya made comments.
There being no further business before Council, Councilman Sawaya made a motion to adjourn the meeting; seconded by Councilman Price and unanimously approved by Council; 9:21 p.m.
