1,450  TONS OF MAGNESIUM CHLORIDE FOR DUST SUPPRESSION

Successful Contractor will be required to furnish all supervision, technical, personnel, labor, materials, machinery, tools, equipment, and services, including utility and transportation services to perform and complete all applications on all specified roads as defined in the bid documents.

Public opening of the bids will be on Thursday, May 30, 2019 at 2:10 P.M. located at the Lincoln County Planning & Engineering Office, 925 Sage Ave, Suite 201, Kemmerer, Wyoming.  Bidders are welcome to attend. 

This project is partially funded using Federal Grant Funds. Therefore, all Federal Requirements associated with the use of these funds must be followed for this project. 

All bids must be accompanied by either a certified check, cashier’s check drawn on an acceptable bank, or an acceptable BID BOND, executed by an approved Surety Company, in an amount not less than five percent (5%) of the total sum of the bid.  The check or bond shall be made payable to Lincoln County and shall be forfeited as liquidated damages if the bidder, upon the letting of the contract to him, fails to enter into the contract within thirty (30) days after it is presented to him for that purpose or fails to proceed with the performance of the contract in a timely manner.

All projects over $150,000.00 shall be bonded therefore the successful bidder shall provide a 100% performance and payment bond.  All projects over $7,500.00 or less than $150,000.00 requires a form of guarantee as approved by the County

INVITATION TO BID

Separate sealed bids for construction of Kemmerer-Diamondville Joint Powers Board Emerald Street Waterline Replacement will be received by Kemmerer-Diamondville Water and Wastewater Joint Powers Board from bidders.

Bids will be publicly opened and read aloud at  11:00 AM on  June 6, 2019 at  The KDJPB Office, 220 Highway 233, Kemmerer, Wyoming      .

The work to be performed under this project shall consist of furnishing all labor, materials and equipment required to construct the facilities and features called for by the CONTRACT DOCUMENTS and as shown on the DRAWINGS. 

KDJPB Emerald Street Waterline Replacement Project, as detailed in the Drawings and Specifications. Project generally consists of the replacement of 800 feet of 12” diameter steel pipe using trenchless methods

This project is funded by Wyoming State Land & Investment Board, KDJPB.

Plans and specifications have been prepared by Sunrise Engineering, Inc. and will be available after May 16, 2019 on their website plan room at http://www.sunrise-eng.com. Click on “Plan Room” at the top of the homepage. Bidders must register and sign-in and choose to become a plan holder to obtain access to CONTRACT DOCUMENTS and DRAWINGS. Notices regarding changes/amendments to the CONTRACT DOCUMENTS and DRAWINGS will be sent to the e-mail address associated with the bidder’s registration. Bidders are responsible to maintain current and correct contact information and check the planroom often to receive updates or additional documents/changes/amendments. The ENGINEER for this Contract will be Sunrise Engineering, Incorporated and they will be represented by Ryan J. Erickson, P.E. as Project Engineer.

The Contract shall be let to the responsible certified resident making the lowest bid, if the certified resident’s bid is not more than five percent (5%) higher than that of the lowest responsible nonresident bidder and the resident bidder does not propose to subcontract more than thirty percent (30%) of the work to nonresident contractors (Wyo. Stat. 16-6-101, et seq.).  Resident for this purpose means a person, partnership, limited partnership, registered limited partnership, registered limited liability company or corporation certified as a resident by the Department of Employment prior to bidding upon the Contract and meeting the further criteria in W.S. 16-6-101, et seq.  A resident bidder shall submit a copy of its certificate of residency with its bid.

Pursuant to W.S. 16-6-106, “Preference is hereby given to materials, supplies, agricultural products, equipment, machinery and provisions produced, manufactured, supplied or grown in Wyoming, quality being equal to articles offered by the competitors outside of the state.”

Bid security in the form of a Bid Bond shall be furnished with the bid in the amount of 5% of the total bid.

Contract security in the form a Performance Bond and Payment bond shall be provided pursuant to W.S. 15-1-113(d) and 16-6-112.  The contract security shall be 100% of the contract amount pursuant to W.S. 15-1-113 (d) and (f).

Final Payment will not be made until conditions and requirements of W.S. 16-6-116, 16-6-117, and 15-1-113(h) are met.

Retainage will be held on all progress payments in accordance with W.S. 16-6-702.  Retainage will be Ten percent (10%) and may be held in a contractor designated interest bearing account for retainage in accordance with W.S. 16-6-702, -704 and -705.

PUBLIC NOTICE OF BLASTING SCHEDULE

Pursuant to Public Law 95-87, Section 515 (b)(15)(A) of the Surface Mining Control and Reclamation Act of 1977, and the Wyoming Environmental Quality Act, Statute 35-11-415, Duties of operator, and in accordance with the regulations authorized and promulgated thereunder, Westmoreland Kemmerer, LLC hereby presents notice of blasting operations to be conducted at the Kemmerer Mine.  The specific locations are:

1-UD Complex,  a portion of Tracts 91, 95, 97, 98C, 98B, 99, and 100, T21N, R116W, the active pit area containing 200 acres, more or less, and all located within Lincoln County, WY.

Pit 2-UD,  a portion of E1/2; E1/2W1/2 of Sec. 15, a portion of Section 22, T20N, R117W, the active pit areas containing 310 acres, more or less, and all located within Lincoln County, WY.

I-Area Pit, a portion of or all of Lots 9 and 10 in section 30 and Tracts 80, 81, 82A, 82D, 84A, 84B, 84C, 84D, 85, & 88 T21N R116W, the active pit areas containing 150 acres, more or less, and all within Lincoln County, WY.

All clear signal - Maintained Peak Tone - One Minute

All blasting will be conducted according to the above dates and schedules unless an emergency situation arises which indicates the need for an unscheduled detonation of blasting materials.  These emergency situations may be as follows:

  1. Rain
  2. Lightning
  3. Adverse Atmospheric conditions
  4. Any other unforeseen circumstances which may jeopardize the safety of persons, (operators or public) that may be in the vicinity of the mine site.

Should alterations to the above schedule be necessary, with exception given to emergency situations, further public notice will be advertised accordingly.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules, notice is hereby given of Rocky Mountain Power’s (RMP or the Company) Application to decrease rates under Tariff Schedule 197, 2017 Federal Tax Cut Adjustment.

RMP is a public utility as defined in Wyo. Stat. § 37-1-101(a)(vi)(C), subject to the Commission’s jurisdiction pursuant to Wyo. Stat. § 37-2-112.

On or about December 22, 2017, federal tax legislation was enacted titled “An Act to Provide Reconciliation Pursuant to Titles II and IV of the Concurrent Resolution of the Budget for Fiscal Year 2018” (Tax Cuts and Jobs Act or TCJA). On May 16, 2018, the Company submitted an application proposing to return the benefits of the TCJA. Specifically, RMP requested Commission approval of [i] proposed Tariff Schedule 197 to authorize the Company to reduce currents rates addressing the benefits from the TCJA; and [ii] approve the Stipulation entered into between RMP and Wyoming Industrial Energy Consumers. The Company proposed rate credits that reduce Wyoming customer retail rates by approximately $26.1 million (3.8%). RMP stated the total reduction included an annual credit allocation of $22.5 million in Tariff Schedule 197 to all retail tariff customers using the class cost of service from RMP’s most recent general rate case (Sub 469) as well as an additional allocation of $3.6 million to offset the recent 2018 ECAM docket. By its Memorandum Opinion, Findings and Order Approving Stipulation issued on March 15, 2019, in Sub 469, the Commission approved the part of the Stipulation in which the parties agreed to refund $22.5 million of the tax benefits to customers until the next general rate case using the average-of-period rate base calculations and rejected the part of the Stipulation in which parties agreed to use some of the benefits to automatically offset future costs related to the ECAM and Energy Vision 2020 projects.

On April 17, 2019, RMP filed its Application requesting to decrease rates under Tariff Schedule 197, 2017 Federal Tax Cut Adjustment. Specifically, RMP requests to decrease rates by $0.04 million (or 0.05 percent) to deliver additional benefits from the TCJA. RMP states the $22.5 million refund continues to be reflected in the Schedule 197 rates by the Company is replacing the $3.6 million to offset the 2018 Energy Cost Adjustment Mechanism (ECAM) with rates to refund to customers $3.96 million. The $3.96 million refund will partly offset the costs the Company seek to recover in the 2019 ECAM application which requested a total increase to customer rates of approximately $9.97 million. The Company calculated its proposed rate credits from Schedule 197 using the rate base allocation from the class cost of service study included in Sub 469.

RMP is requesting an effective date of June 15, 2019 for the proposed rates under Tariff Schedule 197. If approved, the proposed rates will result in an overall customer rate reduction of approximately $0.4 million.

The Application may also be viewed on the Commission’s data management system at https://dms.wyo.gov/external/publicusers.aspx.

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules and Special Regulations, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) requesting authority to increase rates on deferred Net Power Costs (NPC) pursuant to Tariff Schedule 95; and to decrease rates pursuant to Tariff Schedule 93, Renewable Energy Credits (RECs) and Sulfur Dioxide (SO2) emission allowances, as more fully described below:

RMP is a public utility, as defined in W.S. §37-1-101(a)(vi)(C), providing retail electric public utility service under certificates of public convenience and necessity issued by the Commission.  RMP is subject to the Commission’s jurisdiction pursuant to W.S. §37-2-112.

On April 15, 2019, the Company submitted an Application together with testimony, exhibits and revised tariff sheets requesting authority to revise and change rates pursuant to two different rate schedules: [i] its Energy Cost Adjustment Mechanism (ECAM) Tariff Schedule 95, requesting approval to increase rates by $6.55 million to recover deferred NPC; and, [ii] its REC and SO2 revenue adjustment mechanism (RRA) Tariff Schedule 93, requesting approval to decrease rates by $132 thousand to reflect the sale of RECs and SO2  emission allowances.  The total ECAM deferral from calendar year 2018 was a charge of approximately $6.55 million, which consists of: [i] deferred ECAM costs after the 30% sharing band; [ii] accrued interest of approximately $209 thousand; [iii] a credit of approximately $55 thousand from the 2017 ECAM; [iv] an increase of approximately $170 thousand from the 2018 ECAM; and, [v] a credit of $100 thousand related to the settlement of the 2017 ECAM.  RMP requests that the Commission approve the proposed increase on an interim basis, effective June 15, 2019, subject to further review and hearing.

The following table summarizes the proposed price changes by tariff rate schedule.  Within each rate schedule, the percentage change to individual customers may be higher or lower than the average due to rate design, customer load factors, and usage characteristics.  The combined effect of the 2019 RRA and ECAM in this Application represents an overall proposed rate increase of approximately $9.82 million or approximately 1.44 percent.
