CITY COUNCIL MEETING MINUTES

October 4, 2022

The Kemmerer City Council met in a special council meeting this 4th day of October, 2022, at 6 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming. The Pledge of Allegiance was recited. Present on roll call were Mayor William Thek, Councilmember Robert Bowen, Councilmember Dale Hicks, Councilmember Bill Price, Councilmember Eric Rudy and Councilmember Mark Quinn. Councilmember Jamie Thornock were absent.

Motion was made by Councilmember Hicks to excuse the absence of Councilmember Thornock; seconded by Councilmember Bowen and unanimously approved by Council present.

Motion was made by Councilmember Hicks to approve the agenda as presented; seconded by Councilmember Price and unanimously approved by Council present.

PUBLIC HEARING:

Mayor Thek opened the public hearing for the potential sale of City of Kemmerer owned property at 821 South Main (Wilcox Building); 6:07 p.m. Brian Tresp made comments to the Council. Mayor Thek closed the public hearing; 6:18 p.m.

Mayor Thek opened the public hearing for the potential sale of City of Kemmerer owned property at 809 and 823 Main Street; 6:18 p.m. David Jackson and Jessica Lozier made comments to the Council. Mayor Thek closed the public hearing; 6:23 p.m.

Mayor Thek opened the public hearing for the potential sale of City of Kemmerer owned property at 823 Pine Ave.  There being no comments, the mayor closed the public hearing; 6:24 p.m.

NEW BUSINESS:

(a) Motion was made by Councilmember Hicks to Pass Approve and Adopt Resolution No 2022-808, a Resolution Finding selling City of Kemmerer Property at 821 South Main (The Wilcox Building) will Benefit the Economic Development of the City of Kemmerer; seconded by Councilmember Bowen as amended with the address correction made to the Resolution and unanimously approved by Council present.

(b) Motion was made by Councilmember Hicks to Pass Approve and Adopt Resolution No 2022-809, a Resolution Finding selling City of Kemmerer Property at 809 and 823 South Main Street will Benefit the Economic Development of the City of Kemmerer; seconded by Councilmember Rudy as amended with the address corrections made to the Resolution and unanimously approved by Council present

(c) Motion was made by Councilmember Hicks to Pass Approve and Adopt Resolution No 2022-810, a Resolution Finding selling City of Kemmerer Property at 823 Pine Ave. will Benefit the Economic Development of the City of Kemmerer; seconded by Councilmember Quinn and unanimously approved by Council present

There being no further business before the Council, Councilmember Hicks made a motion to adjourn the meeting; seconded by Councilmember Rudy and unanimously approved by Council present; 6:36 p.m.

CITY COUNCIL MEETING MINUTES

October 10, 2022

The Kemmerer City Council met in regular session this 10th day of October, 2022, at 7 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming. The Pledge of Allegiance was recited. Present on roll call were Mayor William Thek, Councilmember Robert Bowen, Councilmember Dale Hicks, Councilmember Bill Price, and Councilmember Eric Rudy.  Councilmember Mark Quinn and Councilmember Jamie Thornock were absent.

Motion was made by Councilmember Bowen to excuse the absence of Councilmember Quinn and Councilmember Thornock; seconded by Councilmember Hicks and unanimously approved by Council present.

Motion was made by Councilmember Bowen to approve the agenda as amended to add New Business (e) Extending Two Leases at Old Town Hall, Suite 104 and Suite 202 for an additional two weeks; seconded by Councilmember Hicks and unanimously approved by Council present.

VISITORS’ COMMENTS:

None.

PUBLIC HEARING:

Mayor Thek opened the public hearing for the retail liquor license transfer from Kum and Go 963 to Fast Stop 2231, Inc.; 7:02 p.m.  There being not comment, the mayor closed the public hearing; 7:02 p.m.

PROCLAMATION:

Mayor Thek read and signed a Proclamation proclaiming October 23, 2022 through October 29, 2022, Childhood Cancer Awareness Week.  Mayor Thek read and signed a Proclamation proclaiming October 24, 2022 as World Polio Day.

Motion was made by Councilmember Bowen to approve the items on the consent agenda as presented; seconded by Councilmember Hicks and unanimously approved by Council present. Those items were:

OLD BUSINESS:

(a) Motion was made by Councilmember Price to Pass, Approve and Adopt Ordinance No. 2022 873, An Ordinance Amending Section 23-44 C-Commercial District; seconded by Councilmember Rudy.  The Mayor then called for the question.  Those voting “yea” were Mayor Thek, Councilmember Bowen, Councilmember Price and Councilmember Rudy.  Councilmember Hicks voted “nay.”  Motion carried.

NEW BUSINESS:

(a) Motion was made by Councilmember Hicks to transfer the retail liquor license from Kum and Go 963 to Fast Stop 2231, LLC; seconded by Councilmember Bowen and unanimously approved by Council present.

(b) Motion was made by Councilmember Bowen to authorize the Mayor to sign the Contract for the Sale and Purchase of Municipal Real Estate at 821 South Main Street with 821 South Main, LLC with the striking of Exhibit A; seconded by Councilmember Price and unanimously approved by Council present.

(c) Motion was made by Councilmember Hicks to authorize the Mayor to sign the MOU between the City of Kemmerer, Lincoln County and the South Lincoln County Economic Development Corporation related to the Economic Diversification Liaison; seconded by Councilmember Bowen and unanimously approved by Council present.

(d) Motion was made by Councilmember Bowen to authorize the Mayor to sign the South Lincoln Training and Event Center Utility and Usage Agreements with Lincoln County with an expiration date of December 31, 2022 and December 31, 2023 with the amendment of Natasia Diers’ title be changed to reflect her current position; seconded by Councilmember Rudy and unanimously approved by Council present.

(e) Motion was made by Councilmember Bowen to authorize the mayor to sign lease extensions at Old Town Hall for Suite 104 with Kinjeng Stress Relief and Suite 202 with Rainfire and Canyon Road Development LLC for Suite 202 for an additional two weeks; seconded by Councilmember Rudy and unanimously approved by Council present.

COMMENTS:

City Administrator, Brian Muir, made comments.  Councilman Rudy, Councilman Hicks, Councilman Price, and Councilman Bowen made comments.  Mayor Thek made comments.

There being no further business before the Council, Councilmember Hicks made a motion to adjourn the meeting; seconded by Councilmember Price and unanimously approved by Council; 7:46 p.m.

NOTICE OF INTENT TO APPLY FOR TAX DEED

On July 17, 2018, Richard Tambor purchased the following real property for 2017 delinquent taxes, WILLOW ADDN B 08 L06 T21 R116 S13. The property was taxed in the name of HONE, ROBERT & STELLA. The present owner is HONE, ROBERT & STELLA. The street address is 221 BERYL, Kemmerer, Wyoming.There are no special assessments. The time for redemption will expire on February 8, 2023 . Take notice that Richard Tambor will apply for a Tax Deed on February 9, 2023.
