Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) for authority to revise Section VI., of Rule 7, as more fully described below.

RMP is a public utility as defined in Wyo. Stat. § 37-1-101(a)(vi)(C), subject to the Commission’s jurisdiction pursuant to Wyo. Stat. § 37-2-112.

RMP filed its Application on September 23, 2019, requesting authority to revise Section VI., of Rule 7 (Metering) to include a new option for customers to receive a non-metered service for small usage devices.  In support of the Application, RMP states that the communications industry is currently expanding its infrastructure to meet demand, which requires the installation of small antennas. The areas where such antennas are installed are typically dense commercial areas. In such areas, there is often little space for meter pedestals or other non-pole mounted equipment. To address this constraint on metering the Company is proposing to provide flat rate service to small cell antennas and other loads with less than two kilowatts per point of connection.  The Company proposes that billing for these devices would be determined based on usage of the devices operating at 100% capacity.

This is not a complete description of the Application. Interested persons may inspect the Application at RMP’s business offices throughout Wyoming and at the Commission’s offices in Cheyenne, Wyoming, during regular business hours.

Anyone desiring to file a public comment, statement, intervention petition, protest or request for a public hearing in this matter must do file with the Commission in writing on or before November 15, 2019. PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, notice is hereby given that a public hearing is scheduled regarding the Application of Rocky Mountain Power (RMP of the Company) to decrease rates under Tariff Schedule 197, 2017 Federal Tax Cut Adjustment. The Wyoming Office of Consumer Advocate and Wyoming Industrial Energy Consumers have intervened in this matter. The public hearing is set to commence on Wednesday, November 13, 2019, at 9:00 a.m., in the Commission’s hearing room located at 2515 Warren Avenue, Suite 300, in Cheyenne, Wyoming.

RMP is a public utility as defined in Wyo. Stat. § 37-1-101(a)(vi)(C), subject to the Commission’s jurisdiction pursuant to Wyo. Stat. § 37-2-112.

On or about December 22, 2017, federal tax legislation was enacted titled “An Act to Provide Reconciliation Pursuant to Titles II and IV of the Concurrent Resolution of the Budget for Fiscal Year 2018” (Tax Cuts and Jobs Act or TCJA). On April 17, 2019, RMP filed its Application requesting to decrease rates under Tariff Schedule 197, 2017 Federal Tax Cut Adjustment. Specifically, RMP requests to decrease rates by $0.04 million (or 0.05 percent) to deliver additional benefits from the TCJA. RMP states the $22.5 million refund continues to be reflected in the Schedule 197 rates by the Company is replacing the $3.6 million to offset the 2018 Energy Cost Adjustment Mechanism (ECAM) with rates to refund to customers $3.96 million. The $3.96 million refund will partly offset the costs the Company seeks to recover in the 2019 ECAM application, which requested a total increase to customer rates of approximately $9.97 million. The Company calculated its proposed rate credits from Schedule 197 using the rate base allocation from the class cost of service study included in Docket No. 20000-469-ER-15.

RMP requested an effective date of June 15, 2019 for the proposed rates under Tariff Schedule 197.  The Application was approved on an interim basis on June 28, 2019 pending the Commission’s decision.

All interested persons are encouraged to attend the public hearing which will be conducted in accordance with the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission Rules and Special Regulations. CITY COUNCIL PROCEEDINGS

The Kemmerer City Council met in regular session this 14th day of October, 2019, at 7 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming.  The Pledge of Allegiance was recited.

Present on roll call were Mayor Anthony Tomassi, Councilman Robert Bowen, Councilman Vance Chamberlain, and Councilman Eric Rudy. Absent was Councilman Mark Quinn.

Motion was made by Councilman Rudy to unexcuse the absence of Councilman Quinn; seconded by Councilman Chamberlain and unanimously approved by Council present.

Motion was made by Councilman Bowen to approve the agenda for October 14, 2019 as presented; seconded by Councilman Chamberlain and unanimously approved by Council present.,

TABLED ITEMS:

OLD BUSINESS:

(a) Motion was made by Councilman Bowen to authorize the RFP for the engineering review and design of heating upgrades at the Recreation Center; seconded by Councilman Rudy and unanimously approved by Council present.

NEW BUSINESS:

(a) Motion was made by Councilman Chamberlain to approve Change Order #1 in the amount of $2,784 on the airport project; seconded by Councilman Rudy and unanimously approved by Council present.

(b) Motion was made by Councilman Bowen to table this item; seconded by Councilman Chamberlain and unanimously approved by Council present.

(c) Motion was made by Councilman Chamberlain to accept the resignation of Councilman David Crosland from his council seat in Ward #3; seconded by Councilman Rudy and unanimously approved by Council present.

(d) Motion was made by Councilman Rudy to declare a vacancy to exist in Council Ward #3 and direct staff to advertise to fill the vacant position; seconded by Councilman Bowen and unanimously approved by Council present.

(e) Motion was made by Councilman Bowen to approve the following fee waivers:

50 % fee waiver – Muley Fanatic Wyoming Range Chapter Banquet, Holiday Magic Boutique and Rocky Mountain Elk Foundation; RB. Motion was seconded by Councilman Chamberlain and unanimously approved by Council present.

 Motion was made by Councilman Bowen and seconded by Councilman Rudy to approve 100% fee waivers to Living Waters Community Church Breakfast with Santa, Kemmerer Junior Senior High ACT Testing, Class of 2021 Prom, South Lincoln Medical Center Health Fair, Canyon Elementary PTO fund raiser, and LSR Banquet.  All present voted in favor.

(f) Motion was made by Councilman Bowen to approve the rezoning of K-D Parcels and Parcel KS-6 of Kemmerer South Parcels from R to RE; seconded by Councilman Rudy and unanimously approved by Council present.

(g) John Schubert of the Forest Service addressed Council regarding mitigation of damage to a portion of the Oregon Trail in Lincoln County.  No action was taken.

(h) Motion was made by Councilman Chamberlain and seconded by Councilman Rudy to send a letter to WYDOT concerning speed limit on highway 30 by Antelope Ridge and adding the possibility of a turning lane.  All present in favor.

COMMENTS:

(a) Council heard comments from City Administrator Muir, Councilman Bowen and Mayor Tomassi.

EXECUTIVE SESSION:

Motion was made by Councilman Bowen to recess into executive session as per W.S. 16-4-405(a)(vii); seconded by Councilman Rudy and unanimously approved by Council present, 8:23 p.m.

Motion was made by Councilman Chamberlain to reconvene the regular meeting; seconded by Councilman Rudy and unanimously approved by Council present, 8: 47 p.m.
