AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF KEMMERER TO REZONE PARCELS OF LAND LOCATED ALONG HIGHWAY 30 KNOWN AS THE K-D PARCELS FROM R, SINGLE FAMILY RESIDENTIAL TO RE, VERY LOW DENSITY RESIDENTIAL
WHEREAS, the owner of Parcel KD-6 in the KD Parcels South of Diamondville on Highway 30 has requested a rezoning; and
WHEREAS, the Kemmerer Zoning Board has determined this request meets the requirements of Section 23-162 of the Kemmerer Zoning Code;

ORDINANCE NO. 2021-868
AN ORDINANCE ESTABLISHING THE KEMMERER
JC PENNEY FUND AND ESTABLISHING USES OF THE FUND.
WHEREAS, AN ANONYMOUS DONOR has donated a considerable sum to the City for the benefit of the City residents and visitors of the J.C. Penney Home and Museum and Statue; and
WHEREAS, the City Council wishes to ensure that the contribution is used to fund costs to improve, maintain and otherwise sustain the J.C. Penney Home and Museum, erect and maintain the J.C. Penney Statue, maintain the J.C. Penney Wayfinding signs, and/or help fund the J.C. Penney events;
NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Kemmerer, Lincoln County, Wyoming that:
Section 1. The sum of $20,000 is hereby placed in a City account to be called The Kemmerer JC Penney Fund. This fund shall be restricted pursuant to the terms of this ordinance.
Section 2. These funds must only be used to improve, maintain, and otherwise sustain the J.C. Penney Home and Museum, erect and maintain the J.C. Penney Statue, maintain the J.C. Penney Wayfinding signs, and/or help fund the J.C. Penney events.
Section 3. The principal amount of this fund shall not be expended except by a 3/4 vote of the City Council. The principal amount may be invested as part of the City general fund.
Section 4. Proceeds and interest from the fund investment will accrue to the general fund and may be used for general fund purposes.

ORDINANCE NO. 2021-866
AN ORDINANCE OF THE CITY OF KEMMERER, WYOMING ENACTING SECTIONS 13-70 THROUGH 13-72 OF CHAPTER 13 MOTOR VEHICLES AND TRAFFIC, OF THE CITY OF KEMMERER CODE REGULATING THE OPERATION OF OFF-ROAD RECREATIONAL VEHICLES ON CITY STREETS.
WHEREAS, members of the community have approached the governing body about authorizing the operation of Off-road recreation vehicles on city streets which have been designated as part of the Wyoming Off-Road Vehicle Trail System pursuant to W.S. 31-5-1601; and
WHEREAS, the governing body recognizes that off-road recreational vehicles are occasionally operated on city streets for incidental, non-recreational purposes, such as traveling to a neighbor’s residence to plow their snow; and
WHEREAS, the governing body desires to enact an ordinance which authorizes the operation of off-road recreational vehicles on city streets in these limited circumstances subject to certain requirements;
NOW, THEREFORE, BE IT ORDAINED by the governing body of the City of Kemmerer, Wyoming that:
ARTICLE XV. SECTIONS 13-70 through 13-72: Operation of Off-road Vehicles on City Streets of the City of Kemmerer Wyoming is hereby enacted to provide as follows:
Section 13-70. Definitions
Off-Road Recreational Vehicles per W.S. 31-1-101 (k) means:
Type 1 – Any recreational vehicle primarily designed for off-road use which has an unladen weight of two thousand six hundred (2600) pounds or less;
Type 2 – Any unlicensed motorcycle which has an unladen weight of six hundred (600) pounds or less and is designed to be ridden off road with the operator astride upon a seat or saddle and travels on two (2) tires; and
Type 3 – Any multi-wheeled motorized vehicle not required by law to be licensed and is designed for cross-country travel on or over land, sand, snow, ice or other natural terrain and which has an unladen weight of more than nine (950) pounds.
OPERATOR means every person who operates or is in actual physical control of the operation of an off-road recreational vehicle.
Section 13-71 Wyoming Off-road Vehicle Trail. Off-road recreational vehicles may be operated on the streets, roads and travel routes of the City of Kemmerer which have been designated as a Wyoming Off-Road Vehicle Trail by the governing body of the City of Kemmerer in conjunction with the Wyoming Department of State Parks and Cultural Resources as provided in W.S.31-5-1601 and W.S. 31-2-701 through 31-2-707, subject to compliance with the following requirements:
(a) The Off-road recreational vehicle’s shall display a current State of Wyoming Off-road Recreational (ORV) registration decal;
(b) The operator must have a valid driver’s license, and carry proof of current liability insurance
(c) Crossings of main-traveled roadways by the Off-road recreational vehicle shall be made at right angles to the roadway or as nearly so as practicable, but in any case yielding the right-of-way to all traffic in the main-traveled roadway;
(d) When operating at any time from one-half (1/2) hour after sunset to one-half (1/2) before sunrise, the Off-road recreational vehicle shall be equipped with lighted lamps and illuminating devices in accordance with W.S. 31-5-910 through 31-5-940;
(e) The Off-road recreational vehicle shall be equipped with an adequate braking device that may be operated either by hand or foot.
13-72. Incidental Operation. The occasional, incidental operation of Off-road recreational vehicles for non-recreation purposes shall be permitted on city streets subject to the requirements set forth in subsection B above. But in addition, wherever practicable, the Off-road Recreational vehicle shall be operated off the main traveled portion of the city street.

The Kemmerer City Council met in regular session this 12th day of July, 2021, at 7 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming. The Pledge of Allegiance was recited. Present on roll call were Mayor William Thek, Councilman Robert Bowen, Councilman Dale Hicks, Councilman Bill Price, Councilman Mark Quinn, Councilman Eric Rudy, and Councilwoman Jamie Thornock.

(c) Motion was made by Councilman Bowen to pass on second reading Ordinance No. 2021 868, An Ordinance Establishing the Kemmerer JC Penney Contribution Fund and Establishing Use of the Fund; seconded by Councilman Hicks and unanimously approved by Council.
NEW BUSINESS:
(a) Motion was made Councilman Quinn to support WAM Resolution No. 2021-01, A Resolution of the Wyoming Association of Municipalities Relating to the 65th Annual Convention in Cheyenne, Wyoming, July 2021; seconded by Councilman Rudy. The mayor then called for the question. Those voting “Yea,” were Mayor Thek, Councilman Bowen, Councilman Hicks, Councilman Price, Councilman Quinn and Councilman Rudy. Councilwoman Thornock voted “Nay.” Motion carried.
Motion was made Councilman Bowen to support WAM Resolution No. 2021-02, A Resolution Supporting and Recommending the US Congress Propose and Send to the States for Ratification, An Amendment to the US Constitution Clarifying the Distinction Between the Rights of Natural Persons and the Rights of Corporations, Unions, and Other Legal Entities, and Providing Congress and the State Legislatures the Right to Regulate Monies Raised and Spend for Political Purposes; seconded by Councilman Price and unanimously approved by Council.
Motion was made Councilman Price to support WAM Resolution No. 2021-03, Reinstatement of a Municipality’s One-Mile Sphere of Influence; seconded by Councilwoman Thornock and unanimously approved by Council.
Motion was made Councilman Bowen to support WAM Resolution No. 2021-04, A Resolution of the Governing Body of the City of Rawlins, Carbon County, Wyoming, to WAM Advocating for Legislation to Clarify the Lien and Assessment Process by which Municipal Expenses for Abating Nuisances, Dangerous Conditions and Dangerous Building May be Recovered on Behalf of the Taxpayer; seconded by Councilman Price and unanimously approved by Council.
Motion was made Councilman Hicks to support WAM Resolution No. 2021-05, A Resolution of the Governing Body of the City of Rawlins, Carbon County, Wyoming Advocating to the WAM for State Legislation Providing Succinct Municipal Authority to Disincentive Vacant and Abandoned Buildings within the Municipality; seconded by Councilman Quinn and unanimously opposed by Council.
Motion was made Councilman Hicks to support WAM Resolution No. 2021-06, A Resolution Requesting WAM Support for Maintenance for the Full Retail Value of Net Metering; seconded by Councilman Rudy and unanimously opposed by Council.
Motion was made Councilman Hicks to support WAM Resolution No. 2021-07, A Resolution Supporting Efforts to Expand Options for Local Governments to Generate Revenue; seconded by Councilwoman Thornock and unanimously opposed by Council.
Motion was made Councilman Bowen to support WAM Resolution No. 2021-08, A Resolution Requesting WAM Support Reinvigoration of Home Rule; seconded by Councilman Rudy and unanimously opposed by Council.
