FORECLOSURE SALE NOTICE

WHEREAS, default in the payment of principal and interest has occurred under the terms of a promissory note (“Note”) and real estate mortgage (“Mortgage”).  The Mortgage dated December 14, 2005, was executed and delivered by Timothy L. Hargrove and Jennifer J. Hargrove, Husband and Wife (“Mortgagor(s)”) to Beneficial Wyoming Inc., as security for the Note of the same date, and said Mortgage was recorded on December 16, 2005, at Reception No. 914507 in Book 607 at Page 683 in the records of the office of the County Clerk and ex-officio Register of Deeds in and for Lincoln County, State of Wyoming; and

WHEREAS, the Mortgage contains a power of sale which by reason of said default, the Mortgagee declares to have become operative, and no suit or proceeding has been instituted at law to recover the debt secured by the Mortgage, or any part thereof, nor has any such suit or proceeding been instituted and the same discontinued; and

WHEREAS, written notice of intent to foreclose the Mortgage by advertisement and sale has been served upon the record owner and the party in possession of the mortgaged premises at least ten (10) days prior to the commencement of this publication, and the amount due upon the Mortgage on the date of first publication of this notice of sale being the total sum of $132,520.85 which sum consists of the unpaid principal balance of $111,398.06 plus interest accrued to the date of the first publication of this notice in the amount of $4,152.13, plus other costs in the amount of $16,970.66, plus attorneys’ fees, costs expended, and accruing interest and late charges after the date of first publication of this notice of sale;

Notice is hereby given that the State Transportation Commission of Wyoming has accepted as completed according to plans, specifications and rules governing the same work performed under that certain contract between the State of Wyoming, acting through said Commission, and Cache Valley Electric Company. The Contractor, on Highway Project Number I801185 in Lincoln and Uinta Counties, consisting of electrical systems and miscellaneous work, and the Contractor is entitled to final settlement therefore; that the Director of the Department of Transportation will cause said Contractor to be paid the full amount due him under said contract on April 10, 2019.

The date of the first publication of this Notice is February 26, 2019.

CITY COUNCIL PROCEEDINGS

The Kemmerer City Council met in regular session this 11th day of February, 2019, at 7 p.m. in the City Council Chambers, City Hall, Kemmerer, Wyoming.  The Pledge of Allegiance was recited.

Present on roll call were Mayor Anthony Tomassi, Councilman David Crosland, Councilman David McGinnis, Councilman Vance Chamberlain, and Councilman Mark Quinn. Absent were Councilman Robert Bowen and Councilman Eric Rudy.

The new city administrator, Brian Muir, was introduced to public present.

Motion was made by Councilman Crosland to unexcuse the absence of Councilman Bowen and Councilman Rudy; seconded by Councilman Quinn and unanimously approved by Council present.

Motion was made by Councilman Crosland to approve the agenda for February 11, 2019 as amended; seconded by Councilman Quinn and unanimously approved by Council present.

VISITORS’ COMMENTS AND PETITIONS:

(1) Arvid Aase, representing Fossil Butte National Monument addressed council regarding a concept exhibit plan meeting on March 7 & 8.

(b) Motion was made by Councilman Crosland to appoint Jennifer Benson to the Recreation Advisory Board with term ending 12/31/2021; seconded by Councilman McGinnis and unanimously approved by Council present.

Mayor Tomassi recused himself from the meeting at this point. Councilman McGinnis took over as chair of the meeting

(c) Motion was made by Councilman Quinn to approve a blanket liquor catering permit for Luigis for 2019; seconded by Councilman Chamberlain and unanimously approved by Council present.

Mayor Tomassi reentered the meeting.  Councilman Chamberlain recused himself from the meeting at this point.

(d) Motion was made by Councilman Quinn to approve the payment of the invoice to Bugman for check #12870 in the amount of $160.00; seconded by Councilman Crosland and unanimously approved by Council present.

Councilman Chamberlain reentered the meeting at this point.

  1. Councilman Crosland, Councilman McGinnis, Councilman Chamberlain, and Councilman Quinn presented comments.
  2. Mayor Tomassi presented his comments.
